Terms of Use
These Terms of Use govern your use of Dyad: Couple Questions Game (the "App"), provided by Anastasiia Martynovets. By downloading or using the App, you agree to these Terms and to Apple's applicable App Store terms.
Eligibility
You must be at least 17 years old, or the minimum age required in your country, to use the App. If you are under the age of legal majority, a parent or guardian must review and accept these Terms for you. Do not use the App if you do not agree to these Terms.
What the App does
Dyad is a free conversation and guessing game for two people sharing one iPhone. Explore six packs of original English cards, take turns, choose privately and guess your partner’s preference. Set a gentle or playful tone, skip any card and save favorites. Personal answers are not saved. No subscript
License
The App is licensed, not sold. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App on Apple-branded devices you own or control, as permitted by the App Store usage rules and Apple's Standard End User License Agreement.
You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, interfere with, automate abusive access to, or attempt to gain unauthorized access to the App, except where applicable law does not allow that restriction.
Your content
Content you create in the App is stored on your device and remains yours. You are responsible for keeping backups you care about; deleting the App, reinstalling it, or using Delete my data removes that content from the device.
You represent that you own or have the rights and permissions needed for everything you submit. Do not submit confidential information or content that violates another person's privacy, publicity, copyright, trademark, or other rights.
Prohibited use
You may not use the App to create, request, store, or distribute content or take actions that:
- are illegal, fraudulent, deceptive, threatening, harassing, hateful, or defamatory;
- sexually exploit or endanger a child;
- violate privacy, publicity, intellectual-property, or other rights;
- impersonate a person deceptively or use someone's likeness without required consent;
- contain malware, attempt to bypass safeguards or purchase requirements, or disrupt the App or its providers; or
- are used for spam, scams, unauthorized surveillance, or other harmful activity.
We may block requests, remove access to content, limit usage, or suspend access for violations, safety concerns, legal requirements, or abuse prevention.
Free use, subscriptions, and payments
The App is currently free to use and contains no in-app purchases. If paid features are introduced, their prices and terms will be shown on the purchase screen before you confirm, and these Terms will be updated. Any payment would be charged to your Apple Account through the App Store and managed in Apple Account subscription settings.
Third-party services
The App depends on third-party services for App Store distribution and payments, subscription management, crash diagnostics, product analytics, and website hosting. Those services may be unavailable, change, or apply their own terms and policies. See our Privacy Policy for the current provider list.
When you choose to share or export content to another app or service, your use of that destination is governed by its own terms. We do not guarantee that a third-party app is installed, available, or will accept a particular file.
Dyad content and intellectual property
The App, its software, design, text, graphics, branding, bundled content, and other non-user content are owned by us or our licensors and protected by applicable intellectual-property laws. Except for the limited App license and any sharing functionality we expressly provide, no rights in this content are transferred to you.
Feedback
If you voluntarily send suggestions or feedback, you allow us to use it without restriction or compensation, provided we do not publicly identify you without permission.
Availability, changes, and termination
We may update, change, limit, suspend, or discontinue features to improve the App, address safety or legal requirements, manage capacity, or reflect provider changes. Your license ends automatically if you materially violate these Terms. Provisions that by their nature should survive termination will remain in effect.
You can stop using the App at any time and remove its data through Settings → Delete my data. Data deletion and retention are described in the Privacy Policy.
Disclaimer of warranties
To the fullest extent permitted by law, the App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. Nothing in these Terms excludes statutory consumer rights that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, we and our affiliates, officers, employees, licensors, and providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, use, or goodwill, arising from the App. Where liability cannot be excluded, our total liability will not exceed the greater of the amount you paid for the App during the 12 months before the claim or USD $50, unless applicable law requires otherwise.
Apple terms
These Terms are between you and Anastasiia Martynovets, not Apple. Apple is not responsible for the App or its support, and Apple's Standard End User License Agreement applies to the extent these Terms do not cover a matter. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on a U.S. Government prohibited or restricted-party list.
Changes to these Terms
We may update these Terms as the App, our providers, or legal requirements change. We will post the updated version here and revise the effective date. Continued use after an update means you accept the revised Terms, to the extent permitted by law.
