1. Agreement and company information
These Terms of Use form a binding agreement between you and Svitlo Labs LLC (“Svitlo Labs,” “we,” “us,” or “our”). By accessing a service or completing a purchase, you agree to these terms and the policies linked from them. If you do not agree, do not use or purchase the service.
Svitlo Labs LLC is a Wyoming limited liability company. Registered and mailing address: 30 N Gould St Ste R, Sheridan, WY 82801, United States.
If product-specific terms displayed at checkout conflict with these terms, the product-specific terms control for that purchase, except where prohibited by law.
2. Eligibility
You must be at least 18 years old and legally able to enter a contract to purchase a web subscription. You represent that the information you provide is accurate and that you are authorized to use the selected payment method.
Our services are offered internationally where permitted. Availability, features, and prices may vary by product, device, language, region, or applicable law.
3. Digital services and delivery
Svitlo Labs develops consumer software and mobile applications. A web subscription grants a limited, personal, non-exclusive, non-transferable, revocable right to access the digital features or content identified on the purchase page for the subscription period.
Access is delivered electronically after successful payment, normally by linking the purchase to the email address, account, or application flow identified at checkout. You are responsible for using accurate account information and maintaining access to the relevant email and device.
We may improve, update, replace, or discontinue features. If a material discontinuation prevents us from providing a prepaid service, we will provide any remedy required by law and may offer a proportionate refund.
4. Prices, payments, subscriptions, and trials
Checkout disclosure
Before purchase, the checkout page shows the product, total price, currency, billing interval, and any applicable tax. Where a trial or introductory offer applies, checkout also shows its duration, the first charge date, the price afterward, and the recurring billing interval.
Payment processing
Stripe processes web payments for us. By providing a payment method, you authorize Svitlo Labs and Stripe to charge it for the amounts disclosed at checkout, including recurring charges and applicable taxes. Your bank or payment provider may apply separate currency-conversion or other fees.
Automatic renewal
Unless the checkout page expressly states otherwise, web subscriptions renew automatically at the disclosed interval and price until cancelled. Prices may change for a future renewal only after advance notice required by law. Continued use after the change takes effect constitutes acceptance where permitted.
Trials and promotions
Not every offer includes a trial. If a trial is offered, its exact terms appear before purchase. Unless cancelled before the disclosed first charge date, the trial converts to a paid, automatically renewing subscription. One trial or promotion may be limited to one person, household, account, payment method, or product.
5. Cancellation and refunds
To cancel a web subscription, email [email protected] from the email used to purchase and identify the product. Send the request before the next renewal date. A request received before renewal is timely even if our processing completes later; if our processing delay alone causes a renewal charge, we will reverse that charge.
After cancellation, access continues through the end of the paid period unless we state otherwise or a refund ends access earlier. We do not provide prorated refunds for unused time.
The first web subscription payment for each product is eligible for a full refund when requested within 14 days. Renewal payments are non-refundable except for duplicate or erroneous charges, a timely cancellation delayed by us, or when applicable law requires otherwise. Purchases made through Apple’s App Store are billed and administered by Apple and are subject to Apple’s cancellation and refund process, not this web policy.
6. Accounts and acceptable use
You are responsible for keeping credentials secure and for activity under your account. Notify us promptly if you suspect unauthorized access.
You may not:
- Use a service unlawfully, fraudulently, or in a way that harms others.
- Copy, resell, sublicense, scrape, reverse engineer, bypass, or interfere with a service except where applicable law expressly permits.
- Attempt unauthorized access, introduce malicious code, overload infrastructure, or evade security or usage limits.
- Misrepresent identity, payment authorization, eligibility, or affiliation.
- Use our intellectual property except as expressly allowed by these terms.
We may suspend or terminate access when reasonably necessary to address fraud, security, unlawful conduct, material breach, or harm to the service or other users. This does not limit any mandatory refund rights.
7. Intellectual property and feedback
Svitlo Labs and its licensors own the services, software, brands, designs, content, and related intellectual property. These terms grant only the limited access right described above and do not transfer ownership.
If you voluntarily provide feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without obligation to you, provided we do not publicly identify you without permission.
8. Third-party services
Services may interoperate with app stores, payment providers, operating systems, or third-party links. Their own terms and privacy notices govern their services. We are not responsible for third-party services outside our control.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, services are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted or error-free operation or that a service will meet every individual requirement.
To the maximum extent permitted by law, Svitlo Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity. Our aggregate liability relating to a service will not exceed the greater of USD 100 or the amount you paid us for that service during the 12 months before the event giving rise to the claim.
These exclusions do not apply where prohibited, including liability that cannot lawfully be limited or mandatory consumer guarantees.
10. Governing law and disputes
These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Courts with jurisdiction in Wyoming may hear disputes, subject to any mandatory right you have to bring a claim in your place of residence.
Nothing in these terms deprives you of non-waivable consumer protections under the law that applies where you live. These terms do not require arbitration and do not waive participation in a class proceeding where such a waiver would otherwise be relevant.
11. Changes and general terms
We may update these terms prospectively. We will post the revised version and provide additional notice where required for material changes. If a provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a reorganization or business transfer.
